我国老年群体的持续壮大，传统的养老方式难以满足日益增长的老年群体的多元化消费需求，养老服务机构在我国养老消费服务结构中发挥出不可替代的作用。本文阐明我国老龄化社会现状和养老服务机构发展的基本状况，论述养老服务机构侵害老年群体不同类型消费权益的现状分析，从养老服务机构应当承担的经营者义务；国家和消费者协会职责；老年群体司法维权角度分析老年群体消费权益受损的原因。文章提出规范养老服务格式合同条款；根据老年群体的民事行为能力水平确定举证责任分配方式；养老服务机构承担经营者义务；政府组织监管；消费者协会参与解决消费侵权纠纷等建议；细化养老服务格式合同条款法律规定；更为细致的证明责任划分方案体现法律公平追求。消费者协会作为消费者维权的重要途径，在维护老年群体消费权益问题中公益性责任的体现应得到体现。

With the continuous growth of the elderly population in our country, traditional methods of elderly care can no longer meet the diverse consumption needs of the increasingly large elderly demographic. Elder care institutions play an irreplaceable role in the structure of elderly consumption services in our country. This article explains the current status of the aging society in our country and the basic development status of elder care institutions. It discusses the current situation of various types of consumer rights violations of the elderly by elder care institutions, analyzing the reasons for the infringement of the elderly's consumer rights from the perspectives of the obligations that elder care institutions should bear as operators; the responsibilities of the state and consumer associations; and the judicial protection of the elderly's rights. The article proposes suggestions such as standardizing the terms of elder care service contracts; determining the allocation of the burden of proof based on the level of civil capacity of the elderly; elder care institutions fulfilling their operator obligations; government organization supervision; and consumer associations participating in resolving consumer infringement disputes. It also suggests refining the legal provisions of elder care service contract terms and more detailed schemes for the division of the burden of proof to reflect the pursuit of legal fairness. As an important channel for protecting consumer rights, the public responsibility of consumer associations in maintaining the consumption rights of the elderly should be emphasized.
