将《2021年民政事业发展统计公报》的数据与民政部以往发布的离婚统计数据相对比，便可以看出自离婚冷静期制度实施以来，我国在离婚率的降低方面已获得了显著成效。然而，由于离婚冷静期在适用上以及期限上的绝对性，无法全面保护弱势群体的利益。为了探索上述问题的解决途径，本文梳理韩国的协议离婚程序，并分析韩国离婚熟虑期的制度适用以及期限适用上的弹性优势。在此基础上，根据我国离婚冷静期制度存在的法律漏洞，提出符合我国实际情况的完善建议，即在制度适用、期限适用上增加弹性以及加强婚姻登记机关与其他机关的协作，以期真正实现离婚冷静期制度的立法目的。

Comparing the Statistical Bulletin of Civil Affairs Development in 2021 with the divorce statistics released by the Ministry of Civil Affairs in the past, it can be seen that China has achieved remarkable results in reducing divorce demography since its implementation of the cooling-off period system. However, due to the inflexibility of its application and duration, the interests of vulnerable groups have not yet been fully protected in China. In order to explore the solutions to the above problems, this article first reviews the procedures of divorce by agreement in South Korea and then analyzes the advantages of the divorce consideration period system’s flexibility in its application as well as the duration. Furthermore, on the basis of legal loopholes in China's divorce cooling-off period system, suggestions for improvement that are in line with the actual situation in China are proposed, including increasing flexibility in the application of the system as well as the duration, and strengthening the cooperation between the marriage registration authority and other institutions, in order to promote the realization of the legislative purpose of the divorce cooling-off period system.
