美国陪审团成员来自邻近地区是一项传统。本文通过对中外文献的整理，考察了美国陪审员“邻近地区”标准的变化轨迹，具体历史时期包括借助超自然力量审判时期，英国陪审团早期，以及美国陪审团时期。借助超自然力量审判制度选取了广为学界认可的宣誓调查法、神意裁判和决斗裁判。美国陪审团审判时期选取了英属殖民地时期、美国宪法批准时期和《权利法案》时期。选择来自邻近地区的陪审员，由于共同的生活背景，他们在考察案情时会充分考量道德价值与社区共识；来自万里以外的陪审员，由于事先对当事人没有了解，能够没有先见地理智思考，不会因社区感情影响判断。以史为鉴，分析地区正义模型的优长与短板对当代司法正义有重要作用。

This paper sorts the historical development of vicinage requirement of the jury through organizing Chinese and foreign books. Specific historical period includes trail by supernatural forces, the appearance of English jury and American jury. Trail by supernatural forces includes trail by wager of law, trail by ordeal and trail by battle, which are widely approved by many academics. While the American jury developed from the British colonial time, the Constitution’s ratification and the Bill of Rights. Selecting juries from the vicinage enables them to judge the facts with moral standard and common sense based on their community experience. By contrast, summoning juries from miles away ensures the justice of the trail due to the fact that they barely know the parties thus are less likely to be influenced by their emotion. Overall, taking history as a mirror, analyzing benefits and drawbacks of local justice has a significant impact on modern justice.
