目前，我国采用律师行政管理与行业管理相结合的“两结合”律师管理体制，即由司法行政机关和律师协会相结合进行管理的模式。这是一个具有中国特色的律师管理制度。从管理学的高度研究这一律师管理模式具有十分重要的意义。而美国公共政策学家约翰?金登所创立的“多源流理论”，是研究和分析公共政策的重要方法和有益工具。本文结合多源流理论，从问题源流、政策源流、政治源流和“机会之窗”的打开来分析了我国“两结合”律师管理体制的形成和演进。在此基础上，本文对当前“两结合”律师管理体制的效果和不足之处进行了研究，并提出了完善和改进“两结合”律师管理体制的可行性措施和建议。同时，还对“两结合”律师管理体制做了相关展望。

文章主体由七个部分组成。第一部分，主要阐述了从管理学角度研究“两结合”律师管理体制的重要意义，汇总了我国多源流理论研究的现状、律师管理体制研究的现状，并对我国采用多源流理论研究、分析有关政策进行了评价。第二部分，梳理了律师“两结合”管理体制的发展历程。主要介绍了我国改革开放以来，律师管理体制从单一的行政管理，到以行政管理为主，再到司法行政机关与律师协会的“两结合”管理，并进一步发展的内容。第三部分，是多源流理论视野中的“两结合”管理体制的有关分析。主要是从问题源流、政策源流、政治源流和“机会之窗”的打开以及多源流的交汇来分析我国律师管理体制的形成与发展。第四部分，介绍了当前“两结合”律师管理体制的效果。第五部分，分析了当前的“两结合”律师管理体制的不足之处。第六部分，针对“两结合”律师管理体制的不足之处，提出了相关的解决策略与建议。第七部分，总结与展望。

总的来讲，本文发现，基于金登的“多源流理论”的分析框架，我国“两结合”的律师管理体制的形成和发展有其合理性的一面。同时，我们应当看到，当前“两结合”律师管理体制取得了一定的效果。当然，我们也应当看到，“两结合”律师管理体制存在着一些不足之处。这就需要我们有针对性的从进一步解决司法行政机关和律师协会的职责定位落实的角度、坚持管理与服务并重的角度和推进“两结合”的律师管理体制之下的律师政治参与的角度入手，不断的改进和完善我国“两结合”的律师管理体制，从而推动律师管理工作的科学化、正规化和现代化，以为建设社会主义法治国家做出积极的贡献。

At present, our country adopts the “two combination” lawyer management system which combines the lawyer administration and the profession management, that is, the mode which combines the judicial administration department and the lawyer association to manage. This is a lawyer management system with Chinese characteristics. It is of great significance to study this lawyer management model from the perspective of management. The “multiple streams theory” founded by John kingdon, an American public policy scientist, is an important method and useful tool to study and analyze public policy. Based on the theory of the multiple streams theory, this paper analyzes the formation and evolution of the lawyer management system of “two combinations” in China from the perspectives of problem source, policy source, political source and the opening of “window of opportunity”. On this basis, this paper studies the effects and shortcomings of the current “two combination”lawyer management system, and puts forward feasible measures and suggestions to improve and perfect the “two combination” lawyer management system. At the same time, the author also makes a prospect of the “two combination” lawyer management system.

The main body of the article consists of seven parts. The first part mainly expounds the significance of studying the lawyer management system of “two combinations” from the perspective of management, summarizes the current situation of the research on the theory of multiple streams and the research on the management system of lawyers in China, and evaluates the research and analysis of relevant policies of multiple streams in China. The second part combs the development process of the management system of “two combinations” of lawyers. This paper mainly introduces the contents of the lawyer management system since the reform and opening up in China, from the single administrative management to the administrative management, and then to the “two combination” management of the judicial administrative organ and the lawyer association, and further development. The third part is the analysis of the “two combination” management system in the perspective of the multiple streams theory. It mainly analyzes the formation and development of China's lawyer management system from the sources of problems, policies, politics, the opening of “window of opportunity” and the intersection of multiple streams. The fourth part introduces the effect of the current “two combination” lawyer management system. The fifth part analyzes the shortcomings of the current “two combination” lawyer management system. The sixth part, in view of the shortcomings of the “two combination” lawyer management system, puts forward relevant solutions and suggestions. The seventh part, summary and prospect.

Generally speaking, this paper finds that the formation and development of the lawyer management system of “two combinations” in China has its rationality based on the analysis framework of the Kingdon's “multiple streams theory”. At the same time, we should see that the current “two combination” lawyer management system has achieved certain results. Of course, we should also see that there are some deficiencies in the “two combination” lawyer management system. This requires us to improve and perfect the lawyer management system of “two combinations” continuously from the perspective of further solving the responsibilities of judicial administrative organs and bar associations, insisting on the equal emphasis on management and service, and promoting the lawyer political participation under the lawyer management system of “two combinations”, so as to promote the lawyer management work we should learn, regularize and modernize in order to make a positive contribution to the construction of a socialist country ruled by law.
