非国有不可移动文物不仅是社会公共利益的载体，同时也是中华民族文化精神的集中体现。它既具有体现文化多样性的载体功能，又作为私有或集体财产体现着个人、集体生产生活的作用。当前，我国非国有不可移动文物的保护现状不容乐观。论文以我国非国有不可移动文物的典型样态“传统村落”为研究对象，通过分析我国传统村落面临的法律困境，提出相应的法律保护路径，以期对我国非国有不可移动文物形成有效保护。

本文除引文外，分为四个部分：

第一章主要介绍了我国非国有不可移动文物的相关概念与价值。通过辨析可移动文物与不可移动文物、国有不可移动文物与非国有不可移动文物、传统村落的概念，明确非国有不可移动文物的内涵；分析非国有不可移动文物的价值，提高公众的文化自信，为保护和管理非国有不可移动文物奠定基础。

第二章对我国非国有不可移动文物的典型样态-传统村落进行分析。传统村落的保护是物质环境要素和非物质环境要素保护的统一。本文研究对象是非国有不可移动文物，因此本章研究的是传统村落中物质环境要素中的传统建筑。通过上述问题的分析，介绍我国非国有不可移动文物的保护现状。我国非国有不可移动文物面临着由不可抗力因素导致的文物毁损问题及破坏问题。

第三章对我国非国有不可移动文物保护的法律困境进行分析。我国非国有不可移动文物面临着文物保护主体责任不明确、法律保障机制不健全、法律法规不完善等法律困境。

第四章论证未来我国非国有不可移动文物法律保护的法律保护路径。参考他国成功经验，对我国非国有不可移动文物的法律保护工作提出具体建议，即从明确文物保护主体责任、完善法律保障机制、细化非国有不可移动文物的法律依据等方面为我国非国有不可移动文物保护工作寻求新思路。

Non-state-owned immovable cultural relics are not only the carrier of social public interests, but also the concentrated embodiment of the cultural spirit of the Chinese nation. It not only embodies the carrier function of cultural diversity, but also embodies the role of individual and collective production and life as private or collective property. At present, the protection status of non-state-owned immovable cultural relic is not optimistic. The thesis takes traditional village, a typical example of non-state-owned immovable cultural relic, as the research object. By analyzing the legal dilemma faced by Chinese traditional villages, the thesis puts forward the corresponding legal protection path in order to form effective protection for non-state-owned immovable cultural relic.

Apart from citations, this thesis is divided into four parts:

Chapter one mainly introduces the concept and value of non-state immovable cultural relics. By distinguishing the concepts of movable cultural relics and immovable cultural relics, state-owned immovable cultural relics and non-state-owned immovable cultural relics, and traditional villages, the connotation of non-state-owned immovable cultural relics is clarified. To analyze the value of non-state-owned immovable cultural relics, improve the public's cultural confidence and lay a foundation for the protection and management of non-state-owned immovable cultural relics.

In the second chapter, the author analyzes the typical pattern of non-state - owned immovable cultural relics - traditional villages. The protection of traditional villages is the unity of the protection of material and non-material environmental elements. The research object of this thesis is non-state-owned immovable cultural relics, so this chapter studies traditional buildings in the physical environment elements of traditional villages. Through the analysis of above problems, this thesis introduces the protection status of non-state-owned immovable cultural relics. The non-state-owned immovable cultural relic in our country is faced with the problem of destruction and destruction caused by force majeure factors.

Chapter three analyzes the legal dilemma of non-state - owned immovable cultural relic protection. In our country, non-state-owned immovable cultural relics face a legal dilemma such as the unclear responsibility of cultural relic protection subject, imperfect legal safeguard mechanism, and imperfect laws and regulations.

Chapter four demonstrates the legal protection path of non-state-owned immovable cultural relic legal protection in our country. That is, it seeks a new way for non-state-owned immovable cultural relic protection in our country from the aspects of clarifying the subject responsibility of cultural relic protection, perfecting the legal guarantee mechanism and refining the legal basis of non-state-owned immovable cultural relic.
