本文運用漢語詞彙史、詞彙學、翻譯學研究的相關方法，對晚清國際法譯著中的法學用語的来源、構造、特點和發展進行研究。本文主要以《萬國公法》、《公法便覽》、《各國交涉公法論》、《公法新編》四本近代國際法譯著及其英文藍本 (Elements of International Law、Introduction to the Study of International Law、Commentaries upon International Law、International Law)中的法學用語為研究對象，整理出法學用語英漢對照表。在此基礎上，考察近代中國最初引進國際法時譯著中法學用語的群體面貌，主要包括法學用語的來源、構成、特點及發展規律，以期為以後的斷代專業詞彙研究提供歷史借鑒。本文包括六個部分：一、緒論。主要介紹論文的選題原因、研究目標、綜述相關研究的概況，介紹本文研究的價值、方法和步驟。二、近代國際法譯著的形成及法學用語的提取。闡述了近代幾本重要國際法譯著的形成背景、內容及性質，同時對研究對象——法學用語的提取範圍、原則、方法與步驟進行詳細說明。三、近代國際法譯著法學用語的來源。主要考察了法學本族詞語和法學外來詞語兩種類型。四、近代國際法譯著法学用語的構造。五、近代國際法譯著法學用語的特點。重點考察了近代國際法譯著中法學用語的用詞不固定、一個詞形表達多個概念、借用普通詞彙等草創期特徵。六、近代國際法譯著法學用語的發展。考察了近代法學用語的定型化、術語化、現代化規律。

This paper researched into the translation of juristic terminology in the Chinese versions of international laws during the later period of Qing dynasty with the methods applied in the research of Chinese lexical history, lexicology, and translation.A table of the juristic terminology used in English and Chinese was drew in this paper according to the Chinese versions and English versions of Elements of international law, Introduction to the study of International law, Commentaries upon International Law, International law. After that, a general state about the translation of juristic terminology in the beginning of introducing international laws in modern China was described. In the end, this paper analyzed the juristic terminology from origin, formation, and characters with a purpose of providing examples for the later specialized vocabularies research on a special age.This paper includes six parts:1, literature review This part includes the reason for conducting the research, the goal of the research, the review of the relative research, the value, methods and procedures of this research.2, the formation of modern juristic translations and selection of juristic words.3, the origins of juristic terminologyThis paper divided the juristic terminology into juristic original words and juristic borrowed words.
