本文旨在深入探讨中美范围内性骚扰问题的认定标准和法律责任，通过对中美相关法律制度和实践经验的比较，分析中美两国在性骚扰领域的差异和相似之处。本研究首先梳理了中美性骚扰的定义的演变，考察了各国法律框架中的明文规定以及在司法实践中的具体解释和适用，分析不同制度体系下的法律精神的差别。其次，通过比较中美性骚扰认定标准的制定各方面的考量，以揭示各国在认定性骚扰行为时的原则和程序，比较法制的运行即司法过程的差别。最后，本文关注了不同国家在法律责任方面的规定，包括对加害人的刑事责任、民事赔偿责任以及雇主或组织的责任等。通过对中美性骚扰法律体系的比较研究，本文旨在为各国在性骚扰问题上的立法和司法实践提供参考，促进全球性骚扰防治工作的进一步完善。性骚扰问题事关社会公正和人权保障，希望本研究能为构建更加平等、尊重和安全的社会环境提供有益的启示。

The purpose of this paper is to deeply explore the identification standards and legal responsibilities of sexual harassment in China and the United States, and analyze the differences and similarities between China and the United States in the field of sexual harassment by comparing the relevant legal systems and practical experience. This study first combs the evolution of the definition of sexual harassment in China and the United States, examines the explicit provisions in the legal framework of each country and the specific interpretation and application in judicial practice, and analyzes the differences in legal spirit under different systems. Secondly, by comparing the various aspects of the formulation of sexual harassment standards in China and the United States, the principles and procedures of various countries in determining sexual harassment are revealed, and the differences in the operation of the legal system, that is, the judicial process, are compared. Finally, this paper focuses on the provisions of legal liability in different countries, including criminal liability for the offender, civil liability for compensation and the liability of the employer or organization. Through the comparative study of the legal systems of sexual harassment in China and the United States, this paper aims to provide reference for the legislation and judicial practice of various countries on sexual harassment, and promote the further improvement of global sexual harassment prevention and treatment. The issue of sexual harassment is related to social justice and human rights protection, and it is hoped that this study can provide useful enlightenment for building a more equal, respectful and safe social environment.
