法律援助是国家建立的保障经济困难公民和特殊案件当事人获得必要的法律咨询、代理、刑事辩护等无偿法律服务，维护当事人合法权益、维护法律正确实施、维护社会公平正义的一项重要法律制度。法律援助情系贫弱群体，彰显以人为本，关系社会公平正义与和谐稳定。党的十八届三中、四中全会对“完善法律援助制度”提出明确要求，同时中办国办印发了《关于完善法律援助制度的意见》，是对新时期下进一步加强法律援助工作、完善法律援助制度做出了全面部署。近年来，宁夏各级法律援助机构把建立完善法律援助制度作为推进工作的着力点，为建设开放富裕和谐美丽宁夏做出了贡献。然而，在发展过程中，与经济社会发展的实际需求相比，宁夏法律援助工作还存在许多问题，如何解决这些问题，已经成为宁夏政府以及司法行政部门亟待解决的问题。笔者建议，要依据中央的政策，找准宁夏现有工作中存在的弊端，从而有针对性的提出解决宁夏法律援助工作的对策建议，加快改善法律援助现有的工作状况。本文采用理论和实践相结合的研究方法，通过对宁夏回族自治区5市21个县（市、区）法律援助机构及467个法律援助工作站中近300多个法律援助工作站深入调研的基础上，找出了宁夏法律援助工作存在的主要问题，包括民族因素的影响、立法内容不科学、政府责任意识不强，管理责任不明确、人员机构不健全、经费保障偏少、律师资源分布不均、刑事法律援助工作压力较大、配合机制不健全等问题。通过分析这些问题和借鉴近年来新发展起来的荷兰、新西兰法律援助的工作做法，结合宁夏法律援助工作实践状况，提出了完善宁夏法律援助工作的对策建议，主要有完善法律援助立法体系、加强队伍建设、落实政府责任、优化办案模式、提高办案质量五个方面。笔者希望此项调查可以给宁夏党委、政府提出一定的参考价值，从而在当地党委、政府的支持下，使宁夏法律援助工作可以更好地沿着科学化、规范化、法制化的轨道发展，让更多困难群众享有平等获得法律援助的机会，实现社会治理法治化。

Abstract legal aid is a legal system which has the necessary legal consultation, agency, criminal defense and other free legal services for the protection of economic difficulties. The weak legal aid groups, highlighting the people-oriented, social justice and harmony and stability. The party's Fourth Plenary Session of “perfect legal aid system” put forward to make clear a requirement,《 on perfect legal aid system views》in the new period, further strengthen the work of legal aid, perfecting the legal aid system to make a comprehensive plan. In recent years, the legal aid agencies at all levels in Ningxia have set up a perfect legal aid system as the focal point to promote the work, and make a contribution to the construction of a harmonious and prosperous Ningxia. However, in the course of development, with the economic and social development of the actual demand, the Ningxia legal aid system still exist many problems, how to solve these problems, has become the Ningxia government and judicial administrative departments need to solve the problem. The author suggests that, according to the central policy, find out the existing problems of Ningxia's existing work, and thus put forward the countermeasures to solve the legal aid work in Ningxia, and accelerate the improvement of the existing working conditions of legal aid.In this paper, the theory and practice of combining research methods, through the 5 cities in the Ningxia Hui Autonomous Region City, 21 counties (cities, districts) legal aid institutions and 467 legal aid workstations in the work of nearly 300, analysis of Ningxia legal aid system, the problems, including the the influence of national factors，the legislative content is not scientific, the government responsibility is not strong, the management responsibility is not clear, personnel organization is not perfect, the legal resources are distributed unevenly, the criminal legal aid work pressure, coordination mechanism is not sound. This article is to reveal the problems of Ningxia legal aid system, and analyze the development trend of Holland, New Zealand legal aid, combined with the practice of legal aid in Ningxia, we proposed to improve the legal aid system in Ningxia by improving the legal aid legislation system, strengthening the construction of government responsibility, optimizing the handling mode and improving the quality of handling cases. I hope that the legal aid work in Ningxia can be better along the scientific, standardized, legal track development, so that more difficult people enjoy equal access to legal aid, and realize the rule of law.
