朱元璋重典治吏的法律思想是中国古代法制发展过程中较为特殊的现象。因为，虽然历代统治者也重视吏治，却极少对官吏进行严厉、残酷的打击。然而，朱元璋推行重典治吏并非偶然，既有朱元璋个人性格因素，也有当时政治因素，同时也是朱元璋时期社会现实的反映。详细论述朱元璋重典治吏的内容，归纳总结其行为的得失，对于今天中国相关制度与规范的建设和完善，具有十分重要的借鉴意义。本文除引言和结语外，主体内容分为三个部分：第一部分论述了朱元璋重典治吏的法律思想在法律中的体现。首先，本部分对朱元璋重典治吏的主要原因进行了分析，这些原因不仅来自政治、社会方面，还与朱元璋个人主观因素相关。其次，这一部分主要是对《大明律》、《明大诰》作出了简要的介绍，并通过《大明律》与《唐律》、元代法律的比较，《大明律》与《明大诰》的对比，来说明朱元璋重典治吏在法律中是如何体现的。第二部分对朱元璋重典治吏的主要措施和影响进行了分析。朱元璋为了实现其重典治吏、统治国家的目的，采取了许多方法，对于遏制贪污腐化的蔓延、规范吏治，缓和社会矛盾、稳定社会秩序都起到了积极的作用，并推动了明初社会的进步。但同时，朱元璋重典治吏的思想也一定程度压抑了官员从政的积极性，压制了社会活力。第三部分讲述了朱元璋重典治吏法律思想的现代启示。通过对朱元璋重典治吏历史经验的总结，我们可以看到，今天，我们国家对行政行为规范，要在法治的前提下，建立健全依法行政的体系，建立严格的公务员选拔和考核机制，实行公务员劣迹公开制度等措施，这样才能更好地实现对行政行为的规范。

The legal thoughts of officials management by severe laws of Zhu Yuanzhang is a special phenomenon in the development of our ancient law system. Because, although governors in the past Dynasties always did pay attention to take measures to members, rarely severe and cruel measures. But, Zhu Yuanzhang took this severe management was not an occasional thing. The factors came from both his personal characters and politics in that period. At the same time, it also was a reflection of social reality in the Zhu Yuanzhang period. By expounding the contents of Zhu Yuanzhang's severe law management in detail, by summarizing the gains and losses of his behaviors, we can draw great lessons from constructing and perfecting Chinese systems and norms related of today. This paper is composed of the instruction part, the conclusion part and other three parts in the main body. The first part discusses the reflection in law of the legal thoughts of Zhu Yuanzhang's severe law management on officials. First, this part analyses the main reasons about officials’ management by severe laws of Zhu Yuanzhang. They not only come from the aspect of politics and social reality, but also come from personal factors of Zhu Yuanzhang. Second, it introduces Law of Ming Dynasty and DaGao mainly in this part. And illustrates how to reflect officials’ management by severe laws of Zhu Yuanzhang in law by compared Law of Ming Dynasty with Tang Code compared Law of Ming Dynasty with laws of Yuan Dynasty and compared Law of Ming Dynasty with DaGao.It analyses the main measures and effects about officials’ management by severe laws of Zhu Yuanzhang in the second part. In order to make his severe law management come true and to rule the country, Zhu Yuanzhang took a lot of measures. It played a positive role in restraining corruption, moderating officials' contradictions and stabilizing society orders. Meanwhile it pushed society forward in the beginning of Ming Dynasty, but it, in some extent, suppressed officials' enthusiasm and clamped down on social vitality.The third part tells modern enlightenment of the legal thoughts of Zhu Yuanzhang's severe law management. By summarizing the historical experience of his severe law management, we can get that, today in order to standardize administrative act, our country needs, under the rule of law, to improve the system of administration by law, to build up strict mechanism for official election and evaluation. So, it can standardize administrative act well.
