从“卡纳安德斯之板”到“洞穴奇案”，再到各国司法实践中涌现出的大量案例，无不体现着生命冲突型紧急避险这样一个无法回避的法律问题。但到目前为止，对生命冲突型紧急避险问题的探讨争议点很多。所谓生命冲突型紧急避险，是指为了保护本人或者他人的生命权免受正在发生的危险，不得已给第三方较小或者同等的生命权造成损害的行为。本文将分为五个部分对生命冲突型紧急避险问题进行研究探讨： 第一部分是对生命冲突型紧急避险的理论分析。第二部分是生命冲突型紧急避险域外立法考察。第三部分探讨其法律性质。第四部分对其理论依据进行探讨。第五部分则是对完善生命冲突型紧急避险的立法建议。本部分以前四部分的内容作为依托，紧紧围绕我国刑法的现行规定及司法实践，以批判审慎的态度借鉴相关域外先进制度，力图达到完善生命冲突型紧急避险的立法现状的目的。

But so far, there have been many disputes over the issue of emergency conflict avoidance in life conflicts. The life-style emergency hedging refers to the act of protecting the person or another person's right to life from the danger that is occurring, and has no way of causing damage to the third party's smaller or equal right to life. This article will be divided into five parts to study the issue of life conflict-type emergency avoidance。 The first part is the theoretical analysis of the emergency conflict of life conflict. The second part is the investigation of the legislation of the conflict-ridden emergency hedging domain. Third part discusses the legal nature of life conflict-type emergency hedge.The fourth part discusses the theoretical basis for the implementation of life conflict-type emergency hedge.The last part is the legislative proposal for improving the life conflict-type emergency hedge. The content of the previous four parts of this part is based on the current provisions of our country's criminal law and judicial practice. It uses critical and prudent attitudes to draw lessons from related advanced fields and systems, and strives to achieve the goal of perfecting the current state of conflict-based emergency aversion legislation.
