人权从字面上理解是指个人的权利，人权的国际保护一直以来都是国际社会普遍关注的问题。二次世界大战给世界人民带来了灾难，保护人权的要求和呼声也更加强烈。随着国际社会对人权的重视，国际人权法得到了进一步的发展，随之出现了大量的国际人权公约。人权与外交本属于不同范畴的两个概念，但由于国家利益的介入，国际社会便对人权问题展开了激烈的外交斗争，人权与外交便结为一体。人权外交则成为美国重要的外交政策之一，它作为美国对外政策的一部分，经历了不同的阶段并具有不同的特点。本文主要以国际人权法为视角，对美国人权外交进行论述和评析。文章共分为四个部分，第一部分，从总体上阐述了人权外交的内涵，人权的界定以及人权与外交的关系。第二部分，针对国际人权法对人权的保护展开论述，详细地阐释了国际人权法保护人权的内容和国际人权的立法活动。第三部分论述了美国从卡特政府时期到奥巴马政府美国人权外交的表现。文章的最后一部分从国际人权法的视角论述美国的人权外交。

Human rights literally refers to the rights of individuals, the international protection of human rights has been the cocern of the international community. After the Second World War, the issue of human rights have been into the field of international law. With the increasingly strong demands on the protection of international human rights, there has been a large number of international human rights conventions, as represented by the Charter of the United Nations, the International Charter of Human Rights. The concepts of Human rights and diplomacy belong in different areas, but because of the involvement of national interests, the international community launched a fierce diplomatic struggle on human rights issues, human rights and diplomacy become integrated. U.S. human rights diplomacy is a basic state policy implemented by the U.S. government since the 1970s. It is a part of U.S. foreign policy and has gone through different stages. This paper is an analysis of US “Human Right”Diplomacy by the perspective of international human rights law. This paper is divided into four parts. The first part generally described the meaning of human rights diplomacy, the definition of human rights and the relations of human rights and diplomatic. The second part described the protection of human rights against the international human rights law,and then discussed how the interpretation of international human rights law to protect human rights and international human rights legislation in detail. The third part is The United States rights diplomacy performance from the carter administration to the Obama.The last part of the article discusses the U.S. human rights diplomacy from the perspective of international human rights law.
