《民法典》 第1053条将医学禁婚疾病条款改为重大疾病婚姻可撤销条款，保障了婚姻自主权。然而，禁婚疾病条款所存在的疾病范围不明确、疾病治愈/复发时间线以及举证困难等问题，依然延续到了民法典此新增规定中。另外，仅仅以损害赔偿威慑过错方、弥补无过错方，其合理性也值得关注。本文就这些问题提出建议。

Abstract: Article 1053 of the Civil Code removes prohibited diseases from the invalid events of marriage, and replaces it with the provision on the annulment of marriages for serious diseases, which guarantees the right to marital autonomy. However, the problems of unclear scope of disease, cure/recurrence, and difficulties in proving the disease, which existed in the old provision, continue to exist in this new provision of the Civil Code. In addiction, the rationality of deterring the at-fault party and compensating the non-at-fault party by damage compensation alone also deservs attention. This thesis provides suggestions on these issues.
