随着互联网的快速发展,线上购物以其方便迅速和价格低廉的优势,受到了广大消费者的青睐,快递行业也随之呈现蓬勃发展的态势。然而快递业务喷井式的增长使得物流配送“最后一公里”陷入困境,传统送货上门方式下进门难、个人信息易泄露等问题使得物流行业不堪重负。在这样的背景下,智能快件箱应运而生,作为一种智能末端投递模式,智能快件箱能够提供24小时的自助取放件服务,方便收件人随时取件,提高快递员配送效率,增加快递企业营业收入。在快递业务不断扩大以及政府政策大力支持的背景下,智能快件箱这样一个似乎多方共赢的新兴产业,却因相关管理规定的模糊和业务量的暴增,引起了一系列的矛盾和纠纷。本文以此为背景,分为四个部分着重论述以丰巢智能柜为代表的智能快件箱在代收服务环节所面临的法律问题,并提出相应的完善建议,以促进其规范健康的发展。 第一部分,概述我国智能快件箱代收服务现今面临的问题,主要包括相关管理规范层面和实践层面的问题,由于相关法律法规不完善、行业规范模糊,导致快件箱行业虽有法可依,但是不能全面保护收件人的权益,无法全面平衡各方的利益关系。在实践层面,相关的司法裁判不统一以及快递行业的特殊性导致在侵权行为发生后,收件人维权困难,难以化解纠纷,行业乱象丛生。 第二部分,在理论层面,对现存的学术界关于智能快件箱代收服务各方法律关系进行整理汇总,探讨辨析,分析优劣,进而在合同法的框架下提出本文的观点。针对本文观点,论述丰巢智能柜中的代收服务合同的性质以及成立、生效问题。 第三部分,在本文观点下,针对收件人与智能快件箱企业之间的代收服务合同中用户服务协议的相关法律内容进行阐述,明确相关各方的权利义务,对格式条款、免责条款进行解释,进而针对实践中出现纠纷最多的未经收件人同意、收费问题、快件损害(毁损、丢失、延误)问题,明确各方的责任及其承担。 第四部分,针对以上关于智能快件箱代收服务的理论及实践论述,提出相应的建议,进而促进快递末端智能快件箱代收服务的健康发展,真正做到便利千家万户的生活。 最后,本文通过结语的内容,将快件箱代收服务涉及的主要法律问题进行归纳,并总结对应的规制建议,使智能快件箱代收服务环节相关法律问题得以解决,让用户能够更加安心、放心地使用,真正享受互联网科技带来的便利。 |

With the rapid development of the Internet, online shopping has been favored by consumers because of its convenience, rapidity and low price, and the express delivery industry has also shown a booming trend. However, the spurt growth of express delivery business makes the "last mile" of logistics distribution in trouble, and the problems of "time difference" and "location difference" under the traditional door-to-door delivery mode make the logistics industry overwhelmed. In this context, intelligent express box came into being. As an intelligent terminal delivery mode, intelligent express box can provide 24 small self-service pick-up and release services, which is convenient for recipients to pick up items at any time, improve the delivery efficiency of couriers and increase the operating income of express delivery enterprises. However, under the background of the continuous expansion of express delivery business and the strong support of government policies, intelligent express box, a new industry that seems to win in many ways, has caused a series of contradictions and disputes due to the vague relevant management regulations and the sharp increase in business volume. Based on this background, this paper is divided into four chapters, focusing on the legal problems faced by the smart express box represented by HIVE BOX Smart Cabinet in the collection service, and putting forward corresponding suggestions to improve it, so as to promote its standardized and healthy development. The first part, summarizes the problems faced by the intelligent express box collection service in China today, mainly including the related management norms and practical issues. Due to the imperfect relevant laws and regulations and vague industry norms, the express box industry can not fully protect the rights and interests of the recipients and balance the interests of all parties. On the practical level, the inconsistency of relevant judicial decisions and the particularity of the express delivery industry lead to the difficulty in resolving disputes, the difficulty in defending the rights of recipients and the chaos in the industry after the infringement. The second part, on the theoretical level, sorts out and summarizes the existing academic legal relations between the parties of smart express box collection service, discusses and analyzes the advantages and disadvantages, and then puts forward the views of this paper under the framework of contract law. According to the viewpoint of this paper, this paper discusses the nature, establishment and effectiveness of the collection service contract in HIVE BOX Smart Cabinet. The third part, from the point of view of this paper, expounds the relevant legal contents of the user service agreement in the collection service contract between the recipient and the smart express box enterprise, clarifies the rights and obligations of all parties concerned, explains the format clauses and exemption clauses, and further clarifies the responsibilities and responsibilities of all parties in view of the most controversial issues in practice, such as without the consent of the recipient, charging problems and express mail damage (damage, loss and delay). The fourth part, in view of the above theoretical and practical discussion on intelligent express box collection service, puts forward corresponding suggestions, so as to promote the healthy development of intelligent express box collection service at the end of express delivery and truly facilitate the lives of thousands of households. Finally, through the content of the conclusion, this paper summarizes the main legal issues involved in the express box collection service, and summarizes the corresponding regulatory suggestions, so that the legal issues related to the intelligent express box collection service can be solved, so that users can use it more safely and truly enjoy the convenience brought by Internet technology. |
