近年来,我国推行了一系列的高校改革举措以适应新时期我国的社会经济发展,其中之一即为我国高校正在大力推行的教师聘任制度,我们不得不承认教师聘任制给教师带来了巨大的福利,使得教师可以以平等的身份与高校签订合同、就相关事宜进行磋商,但是,我们也要清晰的意识到,推行教师聘任制后,教师作为弱势群体,其合法权益被高校侵害的事件也时有发生。工会组织在高校中扮演着高校教师“主心骨”、“靠山”的作用,当高校教师的权益受到侵害之时,高校工会自然也就成为了高校教师权利的捍卫者,因此,在新时期、新形势下,探讨高校工会如何在教师聘任制的条件下为教师维权、保护教师权利不受侵害也显得尤为重要。本文将以高校推行教师聘任制为切入点,采用案例研究的方法,以本人工作单位A学院为研究对象,具体采取三种搜集方法:一是文献研究,搜集单位内部有关工会工作的文献,对工会的工作进行描述和分析;二是深度访谈,分别访谈党政工会负责人、教师和职工15人,了解他们对工会工作的态度,重点是工会对和和谐校园建设的作用、存在问题以及改进措施;三是案例分析,对A学院的真实维权案例,针对A学院工会的维护职能作用、存在问题以及改进措施进行讨论。在上述三种搜集方法的基础上,本文将对高校教师聘任制这一制度进行概念界定、辨析,对高校工会进行定义,并对相关文献进行综述的背景下,以A学院为例,分析A学院工会在维权过程中存在的问题——维权定位不清、维权机制不明、维权内容手段不力,激发了本人对教师聘任制下高校工会维权职能的新思考,并以美国、英国、日本等教育发达国家的做法为经验借鉴,针对我国国内公立高校的教师聘任制下工会的维权工作按照维权时间的前中后期分别提出了建议。本文中对教师聘任制、工会维权职能的系统梳理,对高校教师以及从事工会工作的同仁有一定的实践借鉴意义。

Recent years, China has carried out several reform initiatives in order to adapt to the social and economic development of our country in the new period, one important initiative is the appointment system for teachers in colleges, of which our country is promoting steadily. we have to admit that the appointment system for teachers has already brought huge benefits, and the teachers have the right to sign the contracts, consult the relevant matters with colleges equally, however, we should clearly aware that since the implementation of the appointment system for teachers, teachers as the vulnerable groups, their legitimate rights and interests being infringed occurs frequently.The trade unions as the bridge and the link between the party and the masses, has been play the role of the teachers’ "backbone" and "backer", when the teachers' rights and interests are infringed, the colleges’ trade unions should naturally become the defenders, therefore, in the new period, it’s important to explore how the colleges trade union protect the rights of teachers, defense the teachers' rights from damage under the condition of the appointment system for teachers on the new situation.This paper will regard the appointment system for teachers as the breakthrough point, using the method of case study and my work place-A college as the research object, adopting three kinds of data collection methods: in the first place is the literature research, collecting relevant documents within A college trade union to describe and analysis on the trade union work; in the second place is the depth interview, I will interview the trade union leader, teachers to understand their attitude to the role of the trade union in the harmonious campus construction and the exist problems and improvement measures; last but not least is the organization of focus group, I will invite the administrators and teachers in different departments to discuss the existing problems, and the improvement measures. Based on the above three kinds of collecting data methods, the paper will definite and analysis on the appointment system for teachers, definite the trade unions in colleges, and on the background of the reviewed the related literature, analysis the rights protection of the trade union on present situation, take A College as an example to analysis the exiting problems and the new thinking of trade union rights issues in the process of the appointment system for teachers, the paper also list some developed countries’ experience as reference, leading our domestic college trade union rights’ protection upon the appointment system for teachers.This paper analyzes the system of appointment for teachers, the trade union rights protection function, so it has great significance for college teachers and colleagues engaged in the trade union.
