近年来，乡村振兴成为国家建设的重点项目，面对深化农村改革的新任务和新要求，
国家出台了若干政策文件，旨在激发乡村的潜力和能量，提高农民生活水平。农村发展的
新形势下，农村人口空心化、老龄化明显，“农二代”进城定居，宅基地出现大量闲置。
在此情势下，宅基地保障功能退步，财产性需求强烈，宅基地闲置、隐性交易现象频发。
农民对宅基地使用权的私权观念浓厚，迫切需要放开宅基地流转限制，以寻求更大的经济
收益。现行法中的宅基地制度难以适应社会发展需求，宅基地使用权的流转成为顺应历史
趋势的必然走向，于是国家推动三权分置改革，在全国范围内展开一大批试点，以期通过
实践总结出一套具有参考价值的制度设计。但改革先行，立法缺位，导致若干现实问题的
产生，想要真正实现宅基地使用权流转仍有一段较长的道路要走。
本文一共分成四章。第一章从原理层出发逐步剖析宅基地使用权，重点论述了宅基地
使用权及其流转的基本理论，包括概念、特征、意义及制度变迁等。第二章从理论、现行
制度、改革政策三个层面出发，分析了宅基地使用权流转的现状，审视了使用权流转的发
展趋势，并总结了三权分置改革与宅基地使用权流转之间的关系。由于宅基地制度带有明
显的中国特色，因而该部份内容主要以国内宅基地制度为主，在国际土地制度方面未有过
多展开。第三章则指出了宅基地使用权流转过程中存在的问题，包括司法审判结果不一、
三权分置权利构造不明、宅基地所有权弱化、市场配套不健全等。最后，第四章在现存问
题的视阈下，为宅基地使用权流转建言献策，提出了相应解决措施，以期为宅基地制度改
革提供可供参考的意见。

In recent years, Rural Revitalization has become the focus of national construction. Facing
the new tasks and requirements of deepening rural reform, the state has issued a number of
central documents aimed at stimulating the potential and energy of rural areas and improving
farmers' living standards. Under the new situation of rural development, the hollow and aging of
rural population is obvious. The second generation of farmers settle in cities, and a large number
of homesteads are idle. In this situation, the protection function of homestead has regressed, and
the phenomenon of homestead idle and hidden transaction occurs frequently. Farmers have a
strong sense of private rights to the use right of homestead, and there is an urgent need to release
the restrictions on homestead circulation in order to seek greater economic value. The homestead
system in the current law is difficult to meet the needs of social development. The free
circulation of homestead use right is the inevitable trend of the historical trend. Therefore, the
national level promotes the reform of the separation of three rights, and a large number of pilot
work is in full swing. Reform first leads to the absence of legislation. There are still some
practical problems to be solved if we want to truly realize the transfer of homestead use right.
This paper is divided into four chapters. The first chapter focuses on the basic theory of
homestead use right and circulation, including its concept, characteristics, significance and
institutional changes, and gradually analyzes the homestead use right from the basic theory. The
second chapter analyzes the current situation of the circulation of homestead use right, and
examines the development trend of the circulation of homestead use right from the perspectives
of theory, current system and reform policy. Because the homestead system has obvious Chinese
characteristics, this part mainly focuses on the domestic homestead system. The third chapter
points out the existing problems of homestead, including judicial trial, unclear structure of three rights, weakening of homestead ownership, imperfect market supporting and so on. The fourth
chapter starts from the existing problems, puts forward the corresponding solutions, and puts
forward suggestions and suggestions for the circulation of homestead use right.
