阅读是人类传承文明,获取知识和经验,提高全民素养,增强民族凝聚力和国家软实 力的重要途径。从十九世纪七十年代开始,世界各国相继通过立法确立阅读的重要战略地 位,保障公民的阅读权利,推动全民阅读。 我国全民阅读立法工作起步较晚。2013 年,国家新闻出版广电总局明确提出要全力推 动全民阅读立法。此后,地方阅读立法如雨后春笋。至今,已有湖北省,江苏省,深圳经 济特区,烟台市,吉林省等十余个省市先后通过了本地区的阅读促进地方性法规或规章。 在此背景之下,本文拟在探究我国阅读立法现状,包括其立法模式、立法的特点和立法的 不足的基础上,总结出我国阅读立法存在的不足之处,并通过分析、借鉴国外阅读立法的 相关经验,提出针对性的完善方案。 第一章,我国阅读立法的性质及其价值。探讨了阅读立法的相关理论基础,并将其界 定为促进型立法。总结了阅读立法的价值,即保障公民阅读权利和为阅读推广提供保障。
第二章,我国阅读立法的现状。介绍了我国阅读立法的现状。首先是概括了我国阅读 立法的现有法律文件,又从中央和地方两个层面对这些文件进行分类和内容分析。其次是 概括出了我国当前阅读立法的主要特点有以下几个方面:阅读推广的主体呈现多元化,推 广机制较为完善;开创性地设立了统一管理阅读推广相关事宜的议事协调机构;中央与地 方协同发力。同时,本部分还指出了我国阅读立法在立法目的、法律位阶的效力、立法体 例、阅读促进的机制等方面存在一些不足。 第三章,国外阅读立法情况与经验借鉴。介绍了国外阅读立法的具体情况。国外阅读 立法以美国、韩国、日本最完善、最具有代表性和特点。因此,本部分主要考察了这三国 的阅读立法经验,同时总结出世界各国共同的立法成就,以期为我国全民阅读立法的完善 提供有效借鉴。 第四章,加强我国阅读立法的路径。针对我国阅读立法的不足之处,结合国家的具体 国情,同时借鉴国外阅读立法较为系统、完备的国家的理论和制度,提出相应的改善措施。 完善措施有:在立法目的条款当中加入“增强国家文化软实力和增强文化自信”这样的国 家层面的表述;提高法律效力位阶,保障法律实施的效果;完善相关法律文件的立法体例; 突出图书馆在阅读推动中的作用。

Since ancient times, reading has always held a high position in human society. Since the end of the last century, countries around the world have passed legislation to establish the important strategic position of reading, and at the same time arouse social attention to promote citizens of all countries to read. China's reading legislation began in 2013, and the State Administration of Press, Publication, Radio and Television explicitly incorporated reading legislation into the national legislative plan. Since then, local reading legislation has mushroomed. Up to now, more than ten provinces and municipalities, such as Hubei Province, Jiangsu Province, Shenzhen Special Economic Zone, Yantai City and Jilin Province, have successively passed local laws and regulations to promote reading in this region. In this context, this paper intends to explore the current situation of reading legislation in China, including its legislative model, legislative characteristics and legislative deficiencies, and summarize the deficiencies of reading legislation in China, and through the analysis and reference of the relevant experience of foreign reading legislation, put forward targeted improvement programs. The first part mainly discusses the theoretical basis of reading legislation, clarifies the sociological attributes of reading legislation, and defines it as promoting legislation. It summarizes the value of reading legislation, that is, to protect citizens' reading rights and to provide protection for reading promotion. This paper analyses the feasibility of reading legislation in China. From the conclusion, it can be seen that it is completely feasible for reading legislation to have policies, economy, theory and social security in China. The second part mainly introduces the current situation of reading legislation in China. Firstly, it summarizes the existing legal documents of our country's reading legislation, and classifies and analyses them from the central and local levels. Secondly, it summarizes the main characteristics of the current reading legislation in China as follows: the main body of reading promotion is diversified, and the promotion mechanism is relatively perfect; the establishment of

a unified deliberative and coordinating body for the management of reading promotion related matters has been pioneered; and the central and local coordination efforts have been made. At the same time, this part also points out that there are some deficiencies in the purpose of legislation, the effect of legal rank, the style of legislation and the mechanism of reading promotion. The third part mainly introduces the specific situation of foreign reading legislation. Foreign reading legislation is the most perfect, representative and characteristic in the United States, Korea and Japan. Therefore, this part mainly inspects the reading legislation experience of these three countries, and summarizes the common legislative achievements of all countries in the world, in order to provide effective reference for the improvement of reading legislation for all people in our country. The last part mainly aims at the deficiencies of reading legislation in China, combines with the specific national conditions of the country, and draws on the advanced experience of other countries with relatively perfect reading legislation, and puts forward some suggestions for improvement. The main suggestions include: adding the expression of "strengthening the soft power of national culture and enhancing cultural self-confidence" into the legislative purpose clause; improving the legal effect rank and guaranteeing the effect of law enforcement; perfecting the legislative style of relevant legal documents; and highlighting the role of Libraries in reading promotion.
