    随着科学技术的创新和人工智能的不断发展,由人工智能与传统车辆融合而成的自动驾驶汽车的时代已然来临,传统的道路交通犯罪的形态发生了新的变化:一方面自动驾驶技术提升了驾驶的安全性和舒适度,极大地方便了人们的生活,另一方面自动驾驶也存在着较大的安全和隐患,危害性难以估计,自动驾驶汽车肇事可能造成严重的危害后果。为了应对自动驾驶汽车带来的风险,世界各国都在加强对自动驾驶汽车的运输安全的法律规制。当民法和行政法不能对自动驾驶汽车肇事犯罪起到强有力的打击和防范作用的时候,刑法是维护公民权益和维持社会秩序的最终保障,需要对相关责任主体进行刑法规制,督促其刑事责任的承担。 
    论文以自动驾驶汽车肇事的刑法规制为研究对象,主要分为五章。第一章是导论,通过对自动驾驶汽车肇事案例的提出,显示当前社会对于自动驾驶技术的担忧,以此引出论文的研究课题和主要研究内容。第二章首先对规制前提进行概述,介绍自动驾驶汽车的基本范畴,包括其概念、特点、分级标准和行为类型,然后对当前的国内外研究文献进行分析,学习先进的理论和思想,以更好地对规制进行思考,进而提出当前我国的自动驾驶汽车刑法规制现状,包括刑法介入的正当性和必要性,同时探讨自动驾驶技术对我国传统刑法提出的新问题和新挑战。第三章是对刑法规制要素进行研究,规制要素的第一项重要内容是承担刑事责任的主体。在对当前学者间的肯定学说和否定学说进行分析后,论文认为自动驾驶
汽车不能作为刑事责任的承担主体,归责问题和刑事责任由汽车的相关主体,包括研发人员、设计人员、生产厂商、销售者、使用者和所有者承担。规制要素的第二项内容是注意义务的问题,包括理论争议、不同主体的注意义务来源和注意义务的阻却。规制要素的第三项内容是传统因果关系能否对自动驾驶汽车肇事进行规制。在确定了规制要素之后,论文的第四章对自动驾驶汽车肇事的责任分配问题进行了具体的分析,分别对不同主体在故意、过失的情形下,对刑事责任的承担进行论述,以及不负担刑事责任的例外情况进行排除。第五章是对于完善自动驾驶汽车肇事的刑法规制提出建设性的意见,分别从明确责任主体和责任承担、法律规范和制度的构建、增设自动驾驶汽车相关犯罪的罪名以及增加新的刑罚与非刑罚方式等角度进行了完善。

    With the development of science and technology and the progress made in the field of artificial intelligence, the era of self-driving cars, the product of the combination of artificial intelligence and traditional cars, has arrived, and the traditional forms of road traffic crimes have undergone new changes. On one hand, autonomous driving technology improves the safety and comfort of driving, bringing great convenience to human life, on the other hand, there are also large safety and hidden dangers, the harm is difficult to estimate, self-driving car accidents may cause serious harm consequences. In order to deal with the risks brought by autonomous vehicles, countries all over the world are strengthening the legal regulations on the transportation safety of autonomous vehicles. When civil law and administrative law cannot play a strong role in cracking down on and preventing the self-driving car crime, criminal law, as the last line of defense to safeguard the legal interests of citizens and maintain social order, needs to regulate the relevant responsible subjects by criminal law and urge them to bear the criminal responsibility. 
    The first chapter of the paper is an introduction, which shows the concern of the current society for the autonomous driving technology by proposing the accident case of the autonomous driving vehicle, thus leading to the research topic and main research content of this paper. The second chapter first regulation premise for overview of the thesis, introduce the basic category of self-driving cars, including its concept, characteristics, classification standard and behavior types, and then analysis of the current research literature at home and abroad, to learn the advanced theories and ideas, in order to better to think of regulation, then put forward the current self-driving cars in our country criminal law the status quo, It includes the legitimacy and necessity of criminal law intervention, and discusses the new problems and challenges of automatic driving technology to our traditional criminal law. The third chapter of the paper is to study the elements of criminal law regulation, one of which is the subject of criminal responsibility. After analyzing the positive and negative theories among current scholars, the author believes that autonomous driving vehicles cannot be the subject of criminal responsibility, and the attribution and criminal responsibility should be borne by the relevant subjects of cars, including the developer, designer, producer, seller, user and owner. The second regulation element is the problem of duty of care, including theoretical disputes, sources of duty of care of different subjects and the obstruction of duty of care. The third regulation factor is whether the traditional causality can regulate the self-driving vehicle accident. After determining the regulatory elements, the fourth chapter of the paper makes a specific analysis of the distribution of responsibility for the self-driving vehicle accidents, as well as discussing the assumption of criminal responsibility for different subjects in the case of subjective intent and negligence, as well as the exclusion of the exception of not bearing criminal responsibility. After analyzing the criminal liability of the developers, designers, producers, sellers, users and owners of autonomous vehicles, the fifth chapter of the paper puts forward constructive suggestions for improving the criminal law regulation of autonomous vehicle accidents. It is improved from the aspects of clarifying the subject of responsibility and responsibility bearing, constructing legal norms and systems, adding charges related to autonomous driving vehicles, and adding new penalties and nonpenalties.
